H-1B work visa & 2025โ€“2026 Policy Updates

1. Wage-Based Weighted Selection (effective Feb 27, 2026): Random lottery replaced. Higher DOL OEWS wage levels receive more entries: Level IV ~61% odds, Level III ~46%, Level II ~31%, Level I ~15%.

2. Dropbox eliminated (Sep 2, 2025): All H-1B applicants must attend in-person interview. India consulates: Mumbai, New Delhi, Chennai, Hyderabad, Kolkata.

3. $100,000 fee for overseas H-1B beneficiaries (Sep 19, 2025): Exemptions: F-1 students on OPT/STEM OPT inside US, H-1B extensions/transfers/amendments. Fee expires Sep 21, 2026 unless renewed.

4. Mandatory social media vetting (Dec 15, 2025): All H-1B/H-4 applicants must declare social media handles. Supplemental DS-5540 may be required.

5. Premium processing fee increased to $2,965 (Mar 1, 2026).

Important Notice for H-1B Holders in India: As of early 2026, all five India consulates showed limited H-1B interview slots. Book early at ustraveldocs.com. Social media vetting mandatory, dropbox eliminated.

OPT to H-1B Transition Guide for Indian Students

Standard OPT: 12 months; STEM OPT: additional 24 months. H-1B registration opens early March. Cap-gap rule extends OPT until September 30 if H-1B selected. 60โ€‘day grace period if not selected. Alternatives: O-1, L-1, employer international transfer, CPT/new degree.

H-2B work visa
